California Penal Code 288 Charges & Potential Penalties
Penal Code 288 addresses lewd or lascivious acts involving a child that are allegedly committed with the intent to arouse, appeal to, or gratify sexual desire. The precise charge and potential sentence depend on factors such as the child’s age, the accused person’s age, the alleged conduct, and any claim of force or duress.
Common charging provisions include:
- Penal Code 288(a): An alleged lewd act involving a child under 14. A felony conviction generally carries three, six, or eight years in state prison.
- Penal Code 288(b)(1): An alleged act accomplished through force, violence, duress, menace, or fear of immediate unlawful bodily injury. The statutory range is generally five, eight, or 10 years in state prison.
- Penal Code 288(c)(1): Alleged conduct involving a 14- or 15-year-old when the accused is at least 10 years older. This wobbler offense may be charged as a misdemeanor or felony, depending on the facts. The stated ranges are up to one year in county jail for a misdemeanor or one, two, or three years in state prison for a felony.
- Penal Code 288.5: Continuous sexual abuse involving three or more qualifying acts over at least three months by someone with recurring access to a child. A conviction generally carries six, 12, or 16 years in state prison.
A conviction under any part of Section 288 requires lifetime sex offender registration under Penal Code 290. In a Section 288(a) case, probation is available only when special and unusual circumstances justify it. Registration requirements, custody exposure, and sentencing still depend on the statute, allegations, criminal history, charging decisions, and court findings.
